April 18, 2007 Security breach notification laws require businesses and some government agencies to disclose when leaks of personal information occur. 35 states now have such laws, and the US Congress is likely to pass a broad breach notification law this year. The Samuelson Clinic has collected breach notification letters from over 200 security breaches, and is analyzing them to learn more about the breaches, and to make recommendations for new security breach duties. This discussion will consider the state laws, notification practices, and possible policy guidance for states and federal breach notification requirements.
